Hancock object that the sum which should be awarded to them on the termination of their tenancy, under the Landlord and Tenant Act 1927 would not compensate for the loss of goodwill. They requested that a new lease be offered, or be paid a sum of £3500. SWT offered a new lease at an increased rental of £800 (the amount that Amusement Pier Company were offering to take over the lease), this was refused and legal action was taken. The judgement was given that Hancock had created goodwill through their management of the dance hall at the hotel, and were entitled to compensation of £1700 and a new lease for a term of 5 years at rental of £400
